Terms of Use & Sale

These General Terms of Use and of Sale (the “Terms”) govern access to and use of the stbarthexperience.com platform (the “Platform”), operated by St Barth Experience (“SBE”, “we”), and the booking of services offered on the Platform by independent partner providers (the “Providers”). By creating an account or making a booking, you accept these Terms without reservation.
1. What the Platform is
St Barth Experience operates an online marketplace dedicated to Saint-Barthélemy, connecting customers with independent professional providers of experiences, properties, mobility services and events.
SBE acts exclusively as an intermediary. The contract for the service itself is concluded directly between the customer and the Provider. SBE is not the seller of the listed services and does not employ, represent or supervise the Providers.
2. Your account
Booking on the Platform requires an account. You must be at least 18 years old and legally capable, provide accurate and up-to-date information, and keep your login credentials strictly confidential. You are responsible for all activity carried out through your account.
We may suspend or close an account in the event of fraud, a breach of these Terms or misuse of the Platform, after notifying you where the law requires it.
3. Listings
Listings are created and published by the Providers, under their sole responsibility. Prices, descriptions, photographs, availability and any specific conditions are communicated by each Provider.
SBE carries out reasonable verifications before publication — including, where applicable, tourist accommodation registration numbers and professional liability insurance — but does not guarantee the accuracy or completeness of the information provided by Providers.
4. Booking process
Depending on the listing, a booking is either confirmed instantly or subject to the Provider's acceptance (“booking on request”). For bookings on request, your payment method is authorised when you submit the request; payment is only collected if the Provider accepts, normally within 24 hours. If the request is declined or expires, the authorisation is released and nothing is charged.
The booking summary shows the service, the date(s), the number of participants or the duration, the full price breakdown and the applicable cancellation policy. A confirmation is sent to you by email.
5. Prices, service fee and taxes
Prices are set by the Providers and displayed in euros; amounts shown in any other currency are indicative. A platform service fee is added to the Provider's price and clearly displayed in the price breakdown before payment.
Certain local taxes or charges (for example tourist tax, security deposits or amounts payable on site) may not be collected through the Platform. Where this is the case, the listing states which amounts are payable directly to the Provider.
6. Payment
Payments are processed securely by our payment provider, Stripe. SBE never stores your full card details. The Provider is paid after the service in accordance with the payout schedule applicable to its activity.
7. Cancellation and refunds
Each listing displays the Provider's cancellation policy (for example Flexible, Moderate, Limited, Firm or Strict), including the deadlines and refund levels that apply. The policy shown at the time of booking prevails.
If a Provider cancels a confirmed booking, you are refunded in full. Statutory rights that cannot be waived remain unaffected.
8. Right of withdrawal
In accordance with Article L221-28 of the French Consumer Code, the statutory 14-day right of withdrawal does not apply to accommodation, transport, catering and leisure services that are to be provided on a specific date or during a specific period. Where a right of withdrawal does apply, the listing or the confirmation email explains how to exercise it.
9. Your commitments
When using the Platform, you agree to:
- use the Platform lawfully and only to book services for yourself or your guests;
- provide accurate information when booking — participants, dates, any special requirements;
- comply with the rules communicated by the Provider: house rules, safety instructions, licence or age requirements;
- not use the Platform to arrange a booking outside it in order to avoid the service fee.
10. Provider commitments
Providers are independent professionals. They undertake in particular to hold every registration, licence, authorisation and insurance policy required for their activity (including professional liability insurance where applicable), to describe their services accurately, and to perform them with due skill and care and in compliance with applicable law.
11. Gift cards
Where gift cards are offered on the Platform, their validity period, terms of use and refund conditions are stated at the time of purchase and form part of these Terms.
12. Liability
SBE's role is limited to providing the Platform and its intermediation services with reasonable skill and care. The services booked are performed by the Providers under their own responsibility; SBE is not liable for their performance.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including in the event of gross negligence, wilful misconduct or personal injury.
13. Intellectual property
The Platform, its brand, design, texts, photographs and databases are protected by intellectual property law. You are granted a personal, non-exclusive and non-transferable right to use the Platform for your bookings; any other reproduction or extraction requires our prior written consent.
14. Personal data
Personal data is processed as described in our Privacy Policy and our Cookie Policy, in accordance with the GDPR and the French Data Protection Act.
15. Changes to these Terms
We may update these Terms, in particular to reflect legal, technical or commercial changes. The version in force is the one published on the Platform on the day of your booking; material changes are notified to registered users.
16. Governing law, mediation and disputes
These Terms are governed by French law. In the event of a dispute, please contact us first at contact@stbarthexperience.com — most issues can be resolved amicably.
As a consumer, you may also use, free of charge, the consumer mediation scheme to which SBE belongs [mediator details to be completed] or the European Online Dispute Resolution platform (ec.europa.eu/consumers/odr). Failing amicable resolution, the competent courts have jurisdiction under the ordinary rules of French procedure.
